1. Agreement to Terms
By accessing or using Lumos Gate ("Service"), available at lumosgate.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you") and Lumos Gate ("we", "us", "our") governing your use of the Service.
2. Description of Service
Lumos Gate is an infrastructure management platform that helps users hide and protect their servers by routing traffic through dedicated shield servers (VPS). The Service provides:
- A web dashboard for managing server configurations and traffic routing
- An agent software for deployment on user-managed shield servers
- Traffic routing and load balancing across multiple servers
- Web Application Firewall (WAF) capabilities
- SSL/TLS certificate provisioning and management
- DNS failover configuration
- Traffic analytics and monitoring
Lumos Gate is an infrastructure management tool, not a content hosting service. The Service acts as a management and configuration layer. Users are responsible for their own server infrastructure, domain names, and the content served through their servers. Lumos Gate does not host, store, inspect, or serve end-user content. We do not control what users serve through their infrastructure.
3. Intended Use Cases
Lumos Gate is designed for legitimate infrastructure protection scenarios, including but not limited to:
- Server IP protection: Hiding real server IP addresses behind DDoS-protected shield servers to prevent direct attacks
- Multi-server management: Routing traffic to multiple backend servers from a single entry point with centralized management
- High-availability infrastructure: Auto-failover between multiple shield servers for zero-downtime operation
- Web application protection: Using built-in firewall rules to block common attacks (SQL injection, XSS, etc.)
- SSL management: Automatic certificate provisioning and renewal for multiple domains
- Development and staging: Protecting pre-production environments with the same infrastructure as production
The Service is intended for users who own or have authorized access to the servers they configure. Using the Service to route traffic to servers you do not own or have authorization to manage is prohibited.
4. Account Registration
To use the Service, you must:
- Be at least 18 years of age or the legal age of majority in your jurisdiction
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access to your account
You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use Policy
You agree to use the Service only for lawful purposes. The following activities are strictly prohibited:
5.1. Illegal Activities
- Using the Service in connection with any criminal activity
- Violating any applicable local, national, or international law or regulation
- Facilitating money laundering, terrorist financing, or sanctions evasion
5.2. Phishing and Fraud
- Hosting, distributing, or facilitating phishing websites or campaigns
- Creating fake login pages or credential harvesting sites
- Impersonating any person, business, or entity
- Conducting any form of online fraud or scam
- Using the Service to hide the origin of fraudulent activities
5.3. Malware and Harmful Content
- Distributing malware, viruses, trojans, ransomware, or any malicious software
- Hosting command-and-control (C2) infrastructure for botnets
- Distributing exploit kits or vulnerability exploitation tools for malicious purposes
- Hosting or distributing child sexual abuse material (CSAM) - this will be reported to authorities immediately
5.4. Abuse and Attacks
- Launching or facilitating Distributed Denial of Service (DDoS) attacks
- Network scanning, port scanning, or probing without authorization
- Sending unsolicited bulk email (spam)
- Brute-force attacks against any system
- Unauthorized access to computer systems or networks
5.5. Intellectual Property
- Infringing on copyrights, trademarks, or other intellectual property rights
- Distributing pirated software, media, or other copyrighted material
- Operating counterfeit goods websites
5.6. Prohibited Content
- Content that promotes violence, hatred, or discrimination
- Content that exploits minors in any way
- Content that violates export control or sanctions regulations
Zero Tolerance: Violations of sections 5.2 (Phishing), 5.3 (Malware/CSAM), and 5.4 (DDoS) will result in immediate account termination without prior notice. We cooperate fully with law enforcement agencies and will report illegal activities to the appropriate authorities.
6. Abuse Reporting and Enforcement
We maintain an active abuse handling process. Anyone may report suspected abuse to [email protected].
Upon receiving a valid abuse report, we may:
- Investigate the reported activity
- Suspend the domain or account immediately if warranted
- Permanently terminate the account
- Preserve and disclose information as required by law
- Report illegal activities to law enforcement
We aim to respond to abuse reports within 24 hours on business days.
7. DMCA and Copyright Compliance
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA) and equivalent international copyright laws.
If you believe content served through our Service infringes your copyright, send a DMCA takedown notice to [email protected] including:
- Identification of the copyrighted work
- Identification of the infringing material and its location
- Your contact information
- A statement of good faith belief that the use is not authorized
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
Upon receiving a valid DMCA notice, we will act expeditiously to disable access to the allegedly infringing material.
8. Service Level and Availability
We strive to maintain high availability of the dashboard and management APIs. However:
- The Service is provided on an "as is" and "as available" basis
- We do not guarantee uninterrupted or error-free operation
- Scheduled maintenance may cause temporary unavailability
- The agent software runs on your infrastructure and its availability depends on your server environment
9. User Responsibilities
As a user of the Service, you are responsible for:
- The security and maintenance of your server infrastructure
- All content served through domains configured via the Service
- Ensuring your use of the Service complies with all applicable laws
- Maintaining proper backups of your configurations
- Keeping the agent software up to date
- Responding to abuse complaints related to your domains within 48 hours
10. Fees and Payment
Certain features of the Service require a paid subscription. By subscribing to a paid plan:
- You agree to pay all applicable fees as described at the time of purchase
- Fees are non-refundable except as required by applicable law
- We may change pricing with 30 days advance notice
- Failure to pay may result in account suspension or downgrade
10.1. Cryptocurrency Payments
We accept payments in USDT (Tether) on supported blockchain networks. By paying with cryptocurrency:
- You acknowledge that cryptocurrency transactions are irreversible once confirmed on the blockchain
- You are responsible for sending the correct amount to the correct wallet address
- Payments sent to incorrect addresses or on unsupported networks cannot be recovered
- Plan upgrades are activated after blockchain confirmation (typically within minutes)
- Refunds for cryptocurrency payments, if applicable, will be processed in USDT to the original sending address
11. Nature of Service and Liability
Lumos Gate provides infrastructure management software. We do not provide hosting services and do not operate the servers on which our agent runs. Important distinctions:
- We are a software provider, not a hosting provider. Our agent runs on servers owned and operated by you. We provide configuration management and monitoring tools.
- We do not control user traffic. Traffic flows through your servers, not ours. We have no ability to inspect, modify, filter, or log the actual content of traffic passing through your infrastructure.
- Users are responsible for their infrastructure. You are solely responsible for what runs on your servers, what content is served through your domains, and compliance with laws in your jurisdiction.
- We are not liable for user activities. Lumos Gate shall not be held responsible for any illegal, harmful, or unauthorized activities conducted by users through their own infrastructure.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMOS GATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use of or inability to use the Service
- Any unauthorized access to or alteration of your data
- Any third-party conduct on the Service
- Any content obtained from the Service
- Downtime, data loss, or service interruptions
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless Lumos Gate, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Content served through your configured domains
- Any third-party claims related to your use of the Service
15. Account Termination
We may suspend or terminate your account at any time for:
- Violation of these Terms, particularly the Acceptable Use Policy
- Illegal activities or activities harmful to other users
- Non-payment of fees (for paid plans)
- Extended inactivity (accounts inactive for more than 12 months may be deleted)
- Any reason at our sole discretion, with reasonable notice where practicable
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
17. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service dashboard at least 30 days before they take effect.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
